　　今年3月，北仑区检察院公诉科科长、法学博士潘申明因伤住院，检察长李钟交给他一个任务――“在宽严相济政策实践中创新”。

　　潘在一个月出院后拿出了附条件不起诉实施细则方案。所谓附条件不起诉是指检察机关对应当负刑事责任的犯罪嫌疑人，综合其犯罪事实、情节及人身危险性，认为可不立即追究刑事责任时，给其设立一定考察期，如在考察期内积极履行相关社会义务，足以证实其悔罪表现的，依法作出不起诉决定。

　　这个实施细则(试行)经过几番修改，5月5日由北仑区检察院检委会讨论通过。

　　但王左并不是这个实施细则实行的第一人。此前一起青少年团伙案是第一案。

　　对外来人员一视同仁

　　这起团伙案的5名成员全是在校高中生，来自两个学校，在玩游戏时认识了一名初中生。去年一天，他们5人把这名初中生叫到游戏机房外，打了他一巴掌，拿走了他身上2500元钱。

　　5名高中生被以涉嫌抢劫罪移交北仑区检察院后，在当地影响很大。两家学校校方希望涉案人员能继续就学，由学校教育改造，并向检察院出具了保证书。在得到涉案人员家人的赔偿后，受害者家属也表示谅解。

　　实施细则实施后，北仑区检察院对这5名涉案人员最终作出不起诉决定。

　　有律师指出，在香港，有“社会服务令”和“守行为”，当行为人的违法不太严重，不是一定要追究刑事责任的时候，可以判其在社会福利机构提供无偿的服务或者在一定时期内对其行为进行管束来完成对其的改造。

　　但是在内地，法律规定中并没有类似的代刑方式，因此，检察机关没有权力对刑罚的方式进行创制，以当义工来为其脱罪，不仅没有法律依据，也不符合刑事诉讼的原则。

　　李钟指出，“行善代刑”是媒体的误读，北仑检察院的附条件不起诉实则类似国内的社区矫正，只不过是把关口前移。

　　中国刑法规定，对轻微犯罪可以相对不起诉。但在实践中，对犯罪嫌疑人的惩戒作用并不是很明显。李钟强调，北仑检察院的附条件不起诉是符合刑法和宽严相济的刑事司法政策的。“中央的宽严相济政策比较笼统，我们是深化这个政策，使其具有可操作性，达到政治效果、社会效果和法律效果的统一，这是一个创新。”

　　北仑区检察院公诉科长潘申明说，犯罪嫌疑人一旦被起诉到法院，就会戴上一辈子的枷锁，如果对一些轻微犯罪嫌疑人给予一定的考验期，其内心的悔疚意识也许就会被唤醒。因此，推行该项制度有利于保障轻微犯罪行为人的人权。

　　“我们在制度设计时就考虑了现行法律存在的一些问题，因为通常对犯罪嫌疑人直接作出不起诉决定，在实践中效果不一定很好，一旦作出就没法再处理。我们给了附加条件，一个考察期间，有一个缓冲作用，如果表现不好，还可以起诉。”

　　但这个权力不是潘或是办案检察官个人能决定的。北仑检察院的流程是，由办案检察官拿出附条件不起诉方案，公诉科全体成员集体讨论决定，再经分管副检察长同意，拿到检委会集体讨论决定。

　　“附条件不起诉决定要经过两次检委会：第一次决定是否实施附条件不起诉，第二次决定是否相对不起诉。整个讨论过程均同步录音录像。检委会10多名成员都有意见记录并存档，经得起历史检验。这就有效防止舆论所担心的人情案、关系案的发生。”李钟说。

　　在检委会最终决定不起诉之前，公诉科要递交对犯罪嫌疑人在考察期内的评估报告。这个报告必须根据犯罪嫌疑人是否履行相关义务，悔罪表现是否明显，提出拟撤销附条件不起诉决定或拟作不起诉的意见。

　　“附条件不起诉比较实在，是一个量化的过程，与国外社区矫正类似，也便于我们操作。”办理王左案件的北仑区检察院公诉科检察官徐英杰说。

　　仍面临很多难题

　　但浙大光华法学院副教授李华等多名法律学者也指出，从目前的司法实践看，“附条件不起诉”还面临很多难题，比如，如何让其师出有名，如何合理地界定“附条件不起诉”的适用对象、范围和条件；为防止检察机关滥用起诉裁量权，应当如何设置合理的制约、救济制度 gucci for sale，如何对“附条件不起诉”进行有效监督等等。

　　《民主与法制时报》记者了解到，“附条件不起诉”已在浙江省展开试点。国内一些地方也作了尝试，但争议较大。

14日闭幕的中央经济工作会议指出，在深化重点领域和关键环节改革方面，要研究推进环境保护税改革。多位环境专家在接受《经济参考报》记者采访时，就环境税的开征时机、征税对象、企业税负等问题畅所欲言，各抒己见。

开征时机：环境税立法有过程，基础建设可先行

中国环境学会环境经济专业委员会副主任委员、财政部财政科学研究所副所长苏明表示，近年来，我国经济增长造成的资源环境压力日益加大，经济结构调整任务日益繁重，节能减排、低碳经济面临的国际压力日益沉重，上述因素突出了环境税征收的迫切性。

一位接近环保部的人士接受记者采访时称，现在的《排污费征收使用管理条例》已有较为完备的法律框架，一旦费与税之间融合或过渡，“还有很多技术性问题，比如税率定在多少才能起到‘绿色税’的作用，又不违反宏观税负不增加的‘税收中性’原则，不能认为增加一个税种，就能轻易解决环境问题”。

环保部环境规划院一位专家也指出，近年来，“税收法定原则”日益受到重视，环境税法律地位的确定需要有个过程，包括定义、税目、税率、税基、纳税申报、税收优惠等具体规定，同时还要制定环境税的征收程序、各项管理规定以及惩罚措施等。该专家提出两大备选方案：一是以人大立法的形式，出台专门的环境税法；二是为尽快产生法律效力，经国务院批准，由环保部和国家税务总局出台《环境税收征收管理条例》。

苏 明 指 出 ， 从 现 在 到 “ 十 二五”末还有四年时间，可用来明确税基税率、征管模式、产业测算等政策框架。上述专家建议，在这段时期，应加紧做好基础工作。“环境税的征税依据是企业的生产和排放数据，有些数据需要通过企业申报来获得。因此要增加相关部门的能力，配备相应设备，建立准确、可靠的排污申报和核实制度。”

中国人民大学环境学院院长马中表示，开征环境税已完成研究阶段，征收方案已上报国务院。但他认 为 ： “ 全 国 人 大 通 过 《 环 境 税法》的立法程序，相对于由国务院颁布《环境税征管条例》要复杂得多，因此明年环境税很难开征”。马中曾先后担任财政部“环境税经济学理论(2007-2008)”项目、国家社科基金重大项目“中国环境税收体系研究(2009-2012)”项目负责人。

征税对象：从污染物逐步过渡到污染产品

苏明提出，环境税的征收对象可先确定为二氧化硫、氮氧化物等污染排放物，待时机成熟后，再拓展到污染产品，“但后者要考虑与现有针对高耗能、高污染产品的消费税制度进行融合”。

苏明认为，环境税开征必须建立在四大框架之上：将过去的排污收费改为税收，抓住环境治理的重点污染排放物先行开征，逐步提高排污费和环境税的征收水平，费改税之后应以税务征收为主、环保部门协助。

环保部环境规划院副院长王金南则向记者透露，在独立型、融入型、综合型环境税的三大方案中，目前达成共识的是“往独立型环境税的方向走”。王金南曾牵头召开近10次环境税方案及试点工作研讨会、专家论证会，并完成《环境税征管模式和能力建设研究》第一阶段研究。

王金南建议，加快推进环境税费政策改革，建立独立型环境税，“建立覆盖污染排放、污染产品、生 态 保 护 、 碳 排 放 等 税 目 的 环 境税，积极推进独立型环境税政策出台”。作为第一步，王金南认为，环境税可以对化学需氧量、氨氮、二氧化硫、氮氧化物四项污染物开征排放税。

广口径的环境税包括污染排放税、污染产品税、生态保护税和碳税。环保部部属研究机构对广义环境税的规划也较为超前。环保部环境规划院在相关研究报告中提出了“三步走”建议。

在 第 一 阶 段(2009年- 2011年)，建议搭建环境税制度框架，开征硫税、C O D (化学需氧量)税等污染物排放税；针对能源产品和一些易导致环境污染的产品征收污染产品税；初步开征生态保护税；引 入 碳 税 ； 将 排 污 费 纳 入 税 改 框架，与污染排放税重叠部分进行费税归位。出台环境税征管条例。

对于窄口径的环境税———污染排放税，环保部环境规划院建议，其征收原则为污染者付费，计税依据为污染物的排放量。目前可以考虑将排污费中的二氧化硫和氮氧化物收费改为税收，开征硫税和氮税。

企业税负：专家建议以税收返还促自主减排

苏明表示，无论是现有的排污费还是未来的环境税，逐步提高费率和税率直到能够填平治理成本，“都意味着征收力度需要大幅度提高，但这可能会让地方经济承受不了，吓跑当地企业，不利于招商引资”。苏明称，他已经注意到，有的地方将二氧化硫排污费征收标准提高了一倍。

上述环保部专家指出，环境税对企业的影响包括正反两面。一方面，环境税的实施会迫使企业负担外部性成本，从而导致企业生产经营成本增加，影响该企业产品的国际竞争力；另一方面，环境税的实施可以促进企业进行技术创新，削减污染的排放量，从而降低污染的社 会 成 本 ， 提 高 全 社 会 的 经 济 福利。

“短期而言，只是将排污企业原有的针对二氧化硫、氮氧化物的排污费改为环境税，而且还会采取相应的税收返还措施，所以对纳税人的税收负担影响不大。”该专家称。

王 金 南 说 ，征 收 环 境 税 对 燃煤 发 电 、钢 铁 、有 色 金 属 、建 材 等行 业 的 税 负 可 能 相 对 较 重 ，其 产业 的 竞 争 力 受 到 一 定 影 响 ；在 一定程度上将使工业制成品、能源、原 材 料 价 格 上 升 ，也 会 影 响 到 消费品价格。

中国石油化学工业联合会环保部 门 相 关 负 责 人 接 受 记 者 采 访 时称 ， 环 境 税 征 收 最 好 不 要 “ 一 刀切”，应针对污染物的污染程度、治理难度确定不同的税率；为了减少石化产业经营压力，尤其是缓解炼油企业亏损问题，建议未来在加征环境税的同时，减征增值税。

　　荆楚网消息 (记者王进良 通讯员王世杰)前晚11时许，记者接读者报料：孝感槐荫大道西段的迪士尼水上世界，有一个小男孩被吸进抽水管而死。记者闻讯赶到现场时，众多市民还没有散去，在马路边议论纷纷。“太可惜了”，“那孩子真是太遭罪了”，惋惜之情流露在每个人的脸上。

　　离现场还有100多米 radii straight jacket white，撕心裂肺的哭声传来：“下午还活蹦乱跳的伢，怎么说没就没了呀？”泳池边的地上，一位头发花白的爹爹哭得死去活来。

　　据了解，他是小孩的外公，而小孩的爸妈因悲伤过度，哭得昏厥后早一步被送到医院了。还有一辆救护车及几名医务人员在原地待命，公安消防等都在现场忙碌。

　　记者通过目击者的介绍，基本还原了事发时的情景。

　　今年暑假，市民曾桂先带12岁儿子乐乐(化名)到迪士尼水上世界报名学游泳。前天下午，他又陪儿子一起过来学。教练教了一会儿后，孩子就自己练习，曾桂先则在不远处看着。

　　约17时许，曾桂先突然感到不对劲――并不是特别大的游泳池里，他来来回回看了好几圈，竟然没找到儿子的身影。他顿时担心起来。

　　随后，游泳池的负责人、几名游泳教练以及其他戏水的市民纷纷帮忙寻找，但仍然没有看到孩子的身影。

　　揪心7小时 抽水管中找出孩子尸体

　　游泳池内的每个角落都找遍，依然一无所获后，大家的目光最后定格在游泳池边一个直径约20厘米的抽水管道，这是唯一没有仔细检查的地方。而且当时抽排水系统好像出现了堵塞，大家推测，乐乐可能被吸入这个铁管里了。

　　迪士尼水上世界主要由一个大游泳池和两个水上滑梯组成。不少孩子都喜欢玩水上滑梯――水泵先将泳池里的水抽到高处的水塔内 herve leger sizing，再从水塔流入两个滑梯，戏水者可以由此体会水上滑梯的刺激。

　　为了保证孩子身体的完整，救援人员调来挖掘机，将管道上方的土方全部挖开，然后利用氧焊切割及电焊切割相结合的办法，经过40多分钟的谨慎操作，才将乐乐身体所在的一段管道切开。

　　因为管道内空间狭窄，孩子的整个身体还是很难取出，他紧紧地堵塞在水管内，且膝盖以下被管道转角处卡住，徒手很难拖出。消防官兵只好先堵住管道一端，从另一端用食用油灌注浸泡10分钟，后利用挖掘机吊起切割下的管道，利用惯性上下震荡管道，使孩子的身体慢慢往外滑。在惯性震荡下，孩子的手臂先慢慢移出，膝盖又从管道的转角处移开。接着，消防官兵用被单裹住孩子身体，采用左右震荡撞击管道的办法，使身体慢慢移动，又过了1个小时，乐乐的身体终于被完整取出。

　　一场网络大火烧到了常州大学，曹博文“火了”。

　　26日上午，常州大学经济管理学院辅导员顾坚接到了曹博文的电话，曹博文说，网上报道了他在家乡做公务员的事，好多记者给他打电话，其中有个记者冒充他的同学。他说，他感觉压力很大。

　　顾坚当即上网，看到了《湖南“官二代”未毕业被安排当公务员》的报道，他安慰曹博文不要太在意，调整心态，不要影响找工作。

　　“这段时间他一直在找工作。”顾坚说，曹博文是常州大学经济管理学院国际经济与贸易072班学生，今年大四。自11月开始，学校连续举办了三四场招聘会，曹博文每次都去，也投了不少简历，还参加了四五家企业的面试。

　　曹博文的两位同学向中国青年报记者证实了这一消息。临近毕业，班里同学都在找工作，或者已经去企业实习了，曹博文也一直在找工作，跑动很积极。

　　顾坚说，本周日和下周一，曹博文都要去参加企业面试，好像想留在常州，没听到他说已经找好工作的事，他的推荐表和就业协议书还一直在学校，一直是空白。

　　顾坚说，经济回暖后，经贸专业学生就业形势开始好转，来招聘的大企业少，中小企业多，国贸班40多位同学半数有了就业意向和实习单位，但都没有签署就业协议，都希望能在毕业前找到更好的单位。

　　“乒乓球打得好，人很活泼，上进心很强。”顾坚说，4年来，他从未和曹博文的家长通过电话，之前并不知道他父亲是做什么的。

　　曹博文的同学告诉记者，大一时，他们知道曹博文的父亲是水利局长，其他的并不清楚。曹博文学习还不错，“没有挂过科”，平时开销和同学们差不多。关于就业意向，曹博文和同学们交流的并不多。

　　记者在常州大学经济管理学院的网站上查询到，去年11月和今年4月的“学生教学活动考勤反馈通报”中，有关于曹博文出勤情况的相关记录。

　　今天早上，好多同学在网上看到了关于曹博文的报道，同宿舍的一位同学第一反应是，“这孩子惨了”。

　　据他室友说，从昨晚开始，曹博文就没回宿舍。
